Participants aged 13 to 17 are eligible to participate in tournaments and compete for prizes, provided all legal and consent requirements are met.

3. Account Registration

When you create an account, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. User Conduct

You agree to use the Platform only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Platform. Prohibited behavior includes, but is not limited to:

  • Harassing, threatening, or defaming other users.
  • Posting or transmitting any content that is obscene, offensive, or illegal.
  • Using automated systems to access the Platform without prior authorization.
  • Impersonating another person or entity.
  • Engaging in fraudulent activities, including cheating in tournaments.

5. Compliance with Texas Law

Division 1 Gaming operates in compliance with the laws and regulations of the State of Texas. Our Platform offers contests that are based on skill, ensuring adherence to legal definitions distinguishing skill-based competitions from games of chance. According to Texas Penal Code §47.01, a "bet" does not include offers of prizes to actual contestants in a bona fide contest of skill. By participating, you acknowledge and agree that the outcomes of contests hosted on the Platform are determined predominantly by skill, knowledge, and strategy rather than chance.

6. Participation in Tournaments

By participating in any tournament or competition on the Platform, you agree to abide by the rules and regulations set forth by Division 1 Gaming. We reserve the right to disqualify any participant who violates these rules. Age-specific tournament eligibility is defined as follows:

  • Participants aged 13 to 17: Eligible to participate in tournaments and win prizes, with appropriate parental or guardian consent.
  • Participants aged 18 and older: Eligible for all tournaments, including those with content and prizes not suitable for minors.

7. Fees and Payments

Division 1 Gaming employs a clear and transparent fee structure:

  • Tournament Registration Fees: A flat 15% administrative fee is deducted during tournament registration. These fees are used to cover operational and administrative costs and do not constitute a portion of the prize pool.

  • Payout Fees: A 5% payout fee and an additional $0.50 service fee are applied to prize distributions to cover processing and administrative costs.

All payments are securely processed through PayPal or Automated Clearing House (ACH) for transactions related to tournament participation and prize distribution. By purchasing any service, you agree to our pricing and payment terms.

8. Intellectual Property Rights

All content on the Platform, including text, graphics, logos, and software, is the property of Division 1 Gaming or its content suppliers and is protected by intellectual property laws. You may not use, reproduce, or distribute any content from the Platform without our prior written permission.

9. Privacy Policy

Your privacy is important to us. Please review our Privacy Policy for detailed information on how we collect, use, and protect your personal information. Specific privacy-related updates pertaining to tournament participation and payment integration include:

  • Tournament Participation: Personal information collected during tournament registration is used solely for managing your participation and ensuring compliance with applicable laws and regulations.

  • Payment Integration: Payment details are processed securely in compliance with relevant data protection laws and are not stored on our servers beyond what is necessary for transaction processing.

10. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. Division 1 Gaming does not warrant that the Platform will be uninterrupted or error-free.

11. Limitation of Liability

To the fullest extent permitted by law, Division 1 Gaming will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use of or inability to use the Platform.
  • Any unauthorized access to or use of our servers and/or any personal information stored therein.
  • Any bugs, viruses, or other harmful code transmitted to or through our Platform by any third party.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Any changes will be posted on this page, and your continued use of the Platform after such changes have been made constitutes your acceptance of the new Terms.
